Welcomes to SMSAAR website (The Website)and it is our pleasure to provide you with our electronic auction services (Auction)  and other properties services according to these terms and conditions (Agreement) and the privacy policy of website.

This Agreement is effective between the client and SMSAAR and is a condition to use the website in each and every time whether the visitor is a client or registered member (Member), or upon your acceptance when you registering as a user of the website, please note that any ambiguity in one or any condition of these terms and conditions shall be interpreted only through another agreements signed off by SMSAAR, and any agreement not signed by SMSAAR "whether it was an oral or in writing" then SMSAAR shall not bear any legal responsibilities or obligations. 

It is not allowed to resort or refer to any other regulations or provisions not mentioned by SMSAAR as described and explained below.

SMSAAR may from time to time change or amend these terms of use and will post a revised copy on this page, so we encourage you to check regularly for any updates. If we make any material changes to these terms of use, we shall notify you via email. Otherwise, continuing on using the website following such changes shall constitute your acceptance of the amended or new terms of use.

The above preamble shall be considered as integral part of terms and conditions that organizing and governing the relationship between SMSAAR and its clients.

The client or the website user should read and accept all of these terms and conditions that contained in this agreement and in the privacy policy, which include those terms and conditions expressly set out below and those incorporated by reference, prior to use SMSAAR website. While reading this agreement, we recommend also access and read information contained in the other documents referred to it in this agreement and posted on the website as they may contain further terms and conditions that apply to the website user or member.

Eligibility and registration 

  • The member and/or the visitor should be in the legal age and full legal capacity to use the website services, in order to access a certain part of this website the visitor is required to register as a member and create e-account in the website and provide certain information may be required by SMSAAR including a valid email address and a password and to disclose any true and correct information that any be required by SMSAAR. If the member wants to participate in any transactions through the website services, he should provide SMSAAR with accurate and true information upon request and keep it updated.
  • It is the member responsibility to maintain the confidentiality and secrecy of his account information, and to inform SMSAAR immediately if he discovers any unauthorized use of his account, the member should not share his login information or password with third parties.
  • After validation of the registration, the user “member" may login to the website and will be able to view more information about auctions, and to execute other functions not available to the visitor who is not a member, In this regard SMSAAR privacy policy is included to be the reference.

Intellectual property

This website is owned by SMSAAR and all Saudi laws and regulations pertaining to the protection of the intellectual property rights as well as all the other laws which can protect this website rights or prevent intrusion on the information, data, database, drawings, images, videos, sounds, logos and ideas included therein, shall be applicable thereto.

Any materials or contents provided in the website are copyrighted and it is prohibited to copy, modify, distribute, display, reproduce, publish and transfer all or part of the content of this website in any form, whether hardcopy or electronic, without obtaining prior consent from SMSAAR in writing.
In addition, all members and client’s trademarks which appeared in this website are intellectual properties to its owners and under their responsibility.

1. SMSAAR Visitor :

The service specifications in the website:

  • Log in and subscriptions to this website are free of charge.
  • Review the real estate listed for auction in the member’s accounts for auction.
  • Adds members from individuals and corporates in smsaar website.
  • The visitor is not allowed to bid in auctions.

2. SMSAAR Member (Individuals) :

The service specifications in the website:

  • Access to all the available services in the website.
  • Review the real estates listed in the members and corporates accounts in the website.
  • Ability to post maximum 10 (ten) real estates in website, for each real estate 6 (six) photos and illustrative video.
  • Use and manage the business scheduling service.
  • Access to the website electronic auctions and participate in it.
  • The annual subscription fees shall be SAR 2,500.


3. Golden Member (Individuals) :

The service specification on the website:

  • Subscription in this category is for individuals only.
  • Access to all available services on the website.
  • Review the real estate offered in the members’ accounts and website for auction.
  • Access and participate in electronic auctions.
  • Post unlimited number of real estates in auction.
  • Use and manage the business scheduling service.
  • Special icon distinguishes the member through searching and presents him as golden member.
  •  Annual subscription fees for this category are SAR   7,500 (Seven Thousand 5 Hundred  Saudi Riyal).
  • Dedicated account manager.


4. SMSAAR member (Corporates ) :

The service specifications in the website:

  • Access to all available services in the website.
  • Review the real estates listed in the members’ accounts and in the website for auction.
  • Ability to post maximum 20 (twenty) real estates in the website, for each real estate 6 (six) photos and illustrative video
  • Use and manage the business scheduling service.
  • Access to the website electronic auctions and participate in it.
  • The annual subscription fee shall be SAR 5000 (Five  Thousand Saudi Riyal).

5. Golden Member (Corporates) :

The service specification on the website:

  • Subscription in this category is for corporates only.
  • Access to all available services on the website.
  • Review the real estate offered in the members’ accounts and website for auction.
  • Access and participate in electronic auctions.
  • Post unlimited number of real estates in auction.
  • Use and manage the business scheduling service.
  • Post an ad in home page of website for (30) thirty days.
  • Special icon distinguishes the member through searching and presents him as golden member.
  •  Annual subscription fees for this category are SAR 40,000 (Fourty Thousand Saudi Riyal).
  • Dedicated account manager.


SMSAAR shall have the right to temporarily change the services charges which are provided by the Website, for promotions reasons or when offering new services.

Subscription fees shall be paid in Saudi Riyal and the currency of auctions subject to the currency of real estate location.

Users liabilities

  • To comply with all general instructions come from SMSAAR.
  • The manipulation of auction and bidding prices is totally prohibited and illegal.
  • Shall not do any actions which can prevent users to access the website or to limit process of access for certain category by any way whatever.
  • Shall not publish wrong or incorrect information or misleading or any information that can cause bad reputation for any party.
  • shall not disturb others who enter the website by sending subjects that spy on other party or causes damages to him or to send message or massages forged in the name of SMSAAR
  • Shall not use break through programs and piracy program, (Hackers) or the robots to enter the site without obtaining prior permission for any reason and to comply with all the provisions of laws related to information technology and its protection.

Termination of services

SMSAAR have the right to limit ,stop or terminate any of the services provided by the Website, SMSAAR have the right to prevent users to enter the website or to delete any subjects published in the website , to take any electronic or legal procedures to prevent the users from interning the website without prior permission, and that in case SMSAAR administration decided that it is necessary to take any of the procedures or actions mentioned above for any reasons , noticing that SMSAAR have the right to cancel the non – activated accounts or the accounts which are not active when necessary.

Customer privacy policy

All members information in SMSAAR are subject to the privacy where information of users in the website is collected through names of the members only and all statistics should done randomly to protect the privacy of user’s information.

  • Terms and Conditions of member (auction Seller)

    The seller shall undertake to pay a commission for SMSAAR (2.5%) out of selling price.
    The fine shall be imposed by (2.5%) out of the value of property in case the seller repeal the offered property from auction without any valid reasons accepted by SMSAAR and he shall be notified for such violation by email
    If the seller repeated the above  mentioned violation at ( B) for the second time the participation in auction shall be stopped and the fine shall be imposed by (5%) out of the value of the listed property and he shall be notified for such violation by email.
    If any one of the users (members) does not carried out the auction for the listed property within (30) days started from date of the auction, the listed property it may be removed without any liabilities on SMSAAR against any parties.

  • Terms and conditions of member (auction buyer ) 

    The right of access to the auction is limited only to SMSAAR members and they may review the listed real estate on the website and enter into the auction whenever is open.
    The Awarding process and the declaration of the results of the auction are subject to the approval of the seller party for each property separately.
    The buyer who win the auction shall be notified by email to pay the entire amount of the property during (10) ten business days period from auction winning date.
    The transfer of property title shall be done by the owner or his attorney to the buyer without any liability for SMSAAR.
    The bidder in auction shall not quit or cancel his bidding, specifically in case after his confirmation, therefore he shall be subject to a fine of (5%) out of the property value.
    Final warning shall be send to the bidder in case he draws back from the auction for a second time and he shall be subject to the fine of (10%) out of property value and the participation in auction shall be stopped in the website.
       
  • Ads services 
     
    SMSAAR may provide his services for the clients whose desires to display their properties at the website
    The properties may be displayed for sale at homepage or the interior pages of the website according to the terms and conditions and privacy policy of SMSAAR.
    The client may displays 10 variable ads (Ten ads) at the homepage of the website for the fees of SAR 50000 (Fifty Thousand Saudi Riyal) per ads and for a period of thirty days.
    The client may display 20 variable ads (Twenty ads) at interior page of the website for the fees of SAR 25000 (Twenty Five Thousand Saudi Riyal) as subscription fees per ads and for a period of thirty days.

  • Account Management

    The clients who desire to manage their accounts through SMSAAR shall subscribe in account management service.
    SMSAAR shall assign one of his professionals to manage the accounts of client.
    The fees for my account service shall be SAR 1000 (One Thousand Saudi Riyal) per month.

  • Properties Management

    SMSAAR shall Assign account manager to manage the properties.
    The clients who desire to management their properties through SMSAAR they can subscribe in my property management service.
    SMSAAR fees shall be 5% out of the deal value against the completion of any contractual deal between the clients and others.

Each and every Appendix referred to hereinabove or attached hereto is hereby incorporated herein by reference as if set forth herein in full.
